EFFECTIVE March 1, 2018 - Affidavits for taxable or exempt transfers are required when recording in the Lexington County Register of Deeds office. Please click here  for SC DOR website to see the deeds that are exempted from the fees.


 

The Lexington County Register of Deeds Mission statement: To Record, Maintain and Preserve all documents pertaining to real property transactions as accurately and efficiently as possible.

 

Register of Deeds office accepts the following documents for real estate recording purposes:

  • Deeds, Deeds of Distribution and Title to real estate
  • Easements and Right of Ways
  • Federal & State Tax Liens – (satisfactions and withdrawals,releases)
  • Mortgages – (satisfactions, modifications, releases)
  • Plats
  • Power of Attorneys
  • UCC Finance Statements- (Uniform Commercial Code)
  • All additional documents deemed recordable by Registrar

 

Register of Deeds Office provides the following services:

  • Performs all duties pertaining to recording of real property, (deeds, mortgages, plats, etc.) documents for availability to the public
  • Performs all duties for recording state and federal tax liens
  • Performs all duties for recording of mechanics liens
  • Maintains and preserves all land records for the county
  • Assist our citizens and the public with obtaining copies of all documents pertaining to real property or financial documents.
  • Collects the state mandated fees for recording of deeds and easements
  • Electronic recording through our partners, Simplifile and CSC

 

Register of Deeds Office does not provide the following services:

  • Legal advice or recommendations of any kind
  • Title searches or lien searches
  • Prepare/Provide forms for recording purposes (Deeds, mortgages, POA, etc.)
  • Witness or notary services
  • Report any information recorded in our office to any of the credit bureaus

 

All records in the Register of Deeds office are Public Record and most are available online. Online Records includes data from 8/1/1984 through current date with images of documents available from 1/1/1997 through current date.

Per SC Code of Laws Section 30-2-330 C

Persons preparing or filing documents to be recorded in The Lexington County Register of Deeds Office may not include, Social Security , Driver's License , State Issued ID, Passport, Checking or Savings Account, Credit or Debit Card which includes debit card number, or personal identification (PIN) code, or passwords in the document, unless expressly required by law. Individuals have the right to request The Register of Deeds to remove an image or copy of an official record placed on Lexington County's ROD Online Search Portal used by ROD to display public records with the following personal information, 

Social Security - Driver's License - State Issued ID  Passport Checking or Savings Account  Credit or Debit Card which includes debit card number, or personal identification (PIN) code, or passwords contained in an official record. 

All request must be made in writing, delivered by mail, electronic transmission (email) or in person, to The Register of Deeds. The request must specify book and page number that contains personal information listed above in order to be redacted.

There is no fee for the redaction pursuant to request.
